New amendments to Federal Rule of Evidence 902 - set to go into effect December 1, 2017 - may impact decisions already being made on data preservation and collection.
The amendments essentially provide that electronic evidence collected in accordance with certain protocols will be afforded a presumption of authenticity for evidentiary use. Thus, this new rule may have a significant impact on electronic evidence preservation and collection practices.
